The Build America, Buy America Act (BABAA) is a pivotal regulation that impacts federally funded infrastructure projects, shaping the materials and products used in construction. Signed into law as part of the Bipartisan Infrastructure Law (BIL)—also known as the Infrastructure Investment and Jobs Act of 2021—BABAA expands and strengthens “Buy America” requirements for U.S.-based projects.

What Is the BABAA?

Effective May 14, 2022, the BABAA mandates that federally funded infrastructure projects use iron, steel, construction materials, and manufactured products that are produced in the United States. This requirement applies to any infrastructure project funded through federal financial assistance, making the BABAA a permanent regulation for public works beyond the BIL and the Inflation Reduction Act.

What Types of Projects Require BABAA Compliance?

The BABAA covers the construction, alteration, maintenance, or repair of public infrastructure financed with federal assistance. Its definition of “infrastructure” is broad, encompassing a wide array of facilities, structures, and systems critical to public services and utilities.

Examples of projects that require BABAA compliance include:

  • Energy and Utilities: Electrical transmission systems, energy facilities, electric vehicle charging stations, and broadband infrastructure.

What Products Are Covered by the BABAA?

BABAA applies to three primary categories of materials and products used in infrastructure projects:

Construction Materials All manufacturing processes occurred in the United States. Non-ferrous metals, lumber, drywall, glass, optical fiber, coatings, clay bricks, and engineered wood products.
Manufactured Products Final assembly of the product
occurred in the United States, and 55% of components are  domestic origin.
Windows, doors, HVAC systems, and composite building materials.


Note that the classification of a product depends on its composition:

  • Single-material items like glass or lumber are considered construction materials.
  • Multi-material products, such as steel-framed windows, are classified as manufactured products. In additional, manufactured products are permanently affixed, like doors and windows.
